Understanding Texas Divorce Laws

Texas allows for both no-fault and at-fault divorces. In a no-fault divorce, one spouse simply states the marriage is “insupportable.” In at-fault divorces, common grounds include adultery, cruelty, abandonment, or felony conviction.

To file for divorce in Texas, one spouse must have been a state resident for at least six months and a resident of the filing county for at least 90 days. Once a divorce petition is filed, there’s a 60-day waiting period before finalization. Texas also imposes a 30-day waiting period before either party can remarry.

Texas is a community property state. That means everything acquired during the marriage is presumed to be jointly owned — and must be divided fairly, not necessarily equally.
